Terms of Service
These Terms of Service (the “Terms”) govern your use of SafeFlue chimney services and the SafeFlue website. By booking or using our services, you agree to these Terms.
Effective date: January 20, 2026
Definitions
- “Company”, “we”, “us”, “our” means SafeFlue.
- “Customer”, “you”, “your” means the person or entity booking or receiving services.
- “Services” means chimney sweeping, inspection, minor repairs, and related offerings described on our website or quotes.
Bookings
Appointments are subject to availability. We may reschedule due to unsafe weather or roof conditions.
- Appointment window: Technicians may arrive anytime within the scheduled window to account for traffic and prior job conditions.
- Access: You must provide clear access to the appliance, flue, attic, roof, and any locked areas required for service.
- Preparation: Please remove fragile items within 6 ft (2 m) of the work area and ensure fireplaces are cold and free of hot embers.
- Rescheduling: We may reschedule for safety concerns including wind, ice, precipitation, or structural hazards.
- On-site scope changes: If conditions differ from your booking description, we may adjust pricing or provide an on-site quote before proceeding.
Cancellations and No-Shows
- Free cancellation up to 24 hours before your appointment time.
- Late cancellation (within 24 hours) may incur a CAD $79 call-out fee.
- No-show or denied access at arrival may incur the full call-out fee.
Customer Obligations
- Ensure safe, unobstructed access to the work area, roof, and parking for service vehicles.
- Secure pets and keep children at a safe distance from work areas and equipment.
- Inform us of any known defects, prior issues, or recent chimney fires before work begins.
- Obtain any necessary building or strata permissions for roof access or work on common areas.
Payments
Prices are in CAD plus applicable taxes. Payment is due upon completion unless otherwise agreed.
- Accepted methods: major credit/debit cards and e-transfer where available. Cheques may require prior approval.
- Deposits: Certain services may require a deposit before scheduling; deposits are applied to the final invoice.
- Additional work: Work beyond the quoted scope will be billed at current rates with your prior authorization.
- Late payment: Overdue balances may accrue interest at 2% per month (24% annually) where permitted by law.
- Refunds: Service fees are refundable only where we fail to deliver the agreed service and cannot reasonably rectify the issue.
Safety
We reserve the right to refuse service where conditions are unsafe or equipment access is blocked.
- Fuel shutoff: You must ensure appliances are turned off and cooled prior to arrival.
- Roof conditions: We may use fall-arrest systems and roof anchors at our discretion; unsafe roofs will not be accessed.
- Asbestos/contaminants: If suspected hazardous materials are present, we will stop work and advise next steps.
Inspections and Reports
- Inspection levels are performed per industry guidelines appropriate to the conditions and customer requests.
- Photos: You authorize the technician to capture photos/videos strictly for documentation, safety, and reporting.
- Findings: Recommendations are based on visible, accessible areas and conditions observed at the time of service.
Liability
We are not responsible for pre-existing issues or defects. Our no-mess policy applies when the area is adequately prepared.
- No consequential damages: We are not liable for indirect, incidental, special, or consequential damages.
- Limitation: Our total liability for any claim is limited to the fees paid by you for the service giving rise to the claim in the prior 3 months.
- Pre-existing conditions: We are not responsible for existing leaks, cracks, drafting issues, or code violations.
- Third-party materials: We are not responsible for failures of products or materials supplied by third parties under their own warranties.
Limited Warranty
- Workmanship: We warrant our workmanship for 30 days from the service date for the specific work performed.
- Exclusions: Normal wear, misuse, weather events, animal intrusion, structural movement, and code changes are excluded.
- Remedy: Your sole remedy is re-performance of the affected service or refund of the related portion of fees, at our discretion.
Use of Website
- Content is provided “as is” for general information and is not professional engineering or code-compliance advice.
- We may update content without notice; availability is not guaranteed and may be interrupted for maintenance.
Privacy
- We collect and use personal information to schedule, deliver, and bill for services, and to communicate with you.
- We do not sell personal information. Data may be shared with payment processors and service partners as needed to perform services.
- You may request access to or deletion of your data subject to legal and contractual requirements.
Force Majeure
Neither party is liable for delays or failures due to events beyond reasonable control, including severe weather, acts of God, or utility outages.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Venue for disputes shall be in Ontario, Canada.
Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes become effective constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
